Client Agreement & Liability Waiver

Definition of Client
For the purposes of this Agreement, “Client” refers to the individual who schedules, books, or participates in a session with Practitioner and who checks the box on the booking form to indicate they have read, understood, and agreed to this Agreement. By checking the box, Client also affirms they are at least 18 years old (or have obtained parental/guardian consent) and acknowledges that this constitutes their electronic signature.

This Client Agreement & Liability Waiver (“Agreement”) is entered into by and between Dilshad Jehangir Mehta (“Practitioner” & “Artist”) and the undersigned client (“Client”). By scheduling, booking, or participating in any session with Practitioner, Client acknowledges, understands, and agrees to the following terms and conditions:

1. Nature of Services

Practitioner provides services which may include, but are not limited to, psychic readings, intuitive guidance, coaching, energy work, and/or spiritual support (“Services”). These Services are intended solely for personal insight, reflection, and growth.

  • Services are not medical, psychological, psychiatric, legal, or financial advice, and should not be relied upon as such.

  • Services are not a substitute for professional care provided by licensed physicians, psychologists, attorneys, financial advisors, or other qualified professionals.

2. No Guarantees

Practitioner makes no representations or warranties, express or implied, regarding the accuracy, completeness, or usefulness of any information provided during the Services. Practitioner does not guarantee specific results or outcomes. Client acknowledges that any reliance on information provided is done at their own discretion and risk.

3. Client Responsibility

  • Client affirms that they are at least eighteen (18) years of age or have obtained written parental/guardian consent.

  • Client accepts full responsibility for all decisions, actions, and outcomes arising from their participation in the Services.

  • Client agrees not to interpret any information provided by Practitioner as medical, legal, financial, or psychological advice.

4. Informational Nature of Suggestions (Out-of-Scope Advice)

From time to time, Practitioner may share intuitive impressions or general information regarding supplements, wellness, lifestyle practices, financial matters, or other personal topics. Client understands and agrees that:

  • Any such information is for informational and personal reflection purposes only and is not professional advice.

  • Practitioner is not licensed to diagnose, prescribe, treat, or advise in any regulated field.

  • Client assumes full responsibility for evaluating and acting upon any such information, and agrees to consult qualified licensed professionals before making decisions.

  • Practitioner shall not be held liable for any outcomes, losses, or damages arising from Client’s use or interpretation of this information.

5. Limitation of Liability

To the fullest extent permitted by law:

  • Practitioner shall not be liable to Client for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of income, emotional distress, or physical injury, arising from or in connection with the Services.

  • Client releases, discharges, and holds harmless Practitioner from any and all claims, demands, causes of action, or liability, known or unknown, arising from or related to the Services.

6. Confidentiality

Practitioner will maintain the confidentiality of all information shared during the Services, except as required by law, including circumstances involving imminent risk of harm to self or others, child or elder abuse, or other mandatory reporting obligations.

7. Medical & Emergency Disclaimer

  • Practitioner does not diagnose conditions, prescribe treatment, or interfere with the care of licensed healthcare providers.

  • Client agrees to seek appropriate medical, psychological, or psychiatric care from licensed professionals for any health-related concerns.

  • In the event of an emergency or imminent risk of harm, Client agrees to immediately contact emergency services (911 in the U.S.) or the appropriate local authorities.

8. No Refund Policy

  • All sessions are non-refundable.

  • A refund will only be considered if Client emails Practitioner before the session to indicate that they do not agree to this Agreement. No other refunds will be issued under any circumstances.

9. Session Forfeit Policy

  • If Client is more than 10 minutes late to a scheduled session, the session will be considered forfeit, and no refund will be provided.

  • If Client cancels within 24 hours of the scheduled session, the session will be considered forfeit, and no refund will be provided.

  • Emergency Exception: If Client provides documented proof of a bona fide emergency (such as a medical emergency, accident, or other unforeseen urgent circumstance), Practitioner may, at their discretion:

    • Reschedule the session for a mutually agreed-upon time, or

    • Provide a refund in whole or in part.

  • Practitioner reserves the right to make decisions on emergencies case by case, but the standard forfeit policy remains in effect for all other situations.

10. Sacred Tattoo Consult & Design Service

I understand that the Sacred Tattoo Consult & Design is a creative and spiritual process intended for personal insight, symbolic exploration, and inspiration only. The intuitive guidance, imagery, and information shared are not medical, psychological, or dermatological advice and should not be interpreted as such.

I understand that any decisions I make about tattooing my body—including placement, design alterations, timing, or working with a tattoo artist—are entirely my personal responsibility.

I acknowledge that the final image provided is a conceptual and artistic interpretation based on intuitive and symbolic insight. Because this service is creative in nature, I understand that aesthetic satisfaction cannot be guaranteed, and I agree that personal preference or dislike of the design does not constitute grounds for refund, revision, or dispute.

I further acknowledge that no guarantees are made regarding aesthetic satisfaction, energetic outcomes, or physical results, and I release the practitioner from all responsibility or liability related to tattoo outcomes, healing processes, allergic reactions, or dissatisfaction with any aspect of the tattoo or its design.

By booking this service, I affirm that I have read, understood, and agree to this section in addition to all other terms of the Client Agreement & Liability Waiver.

11. Intellectual Property & Personal Use License

Ownership
All artwork, sketches, symbols, concepts, and final tattoo designs created remain the intellectual property of the Artist (Dilshad Mehta). Copyright is not transferred to the Client.

Personal Use License
Upon full payment, the Client is granted a perpetual, non-exclusive personal use license to work with the final image in meaningful personal ways. This includes:

  1. Tattooing the design on their body

  2. Meditating with the image, printing it for personal space, or carrying it as a totem

  3. Sharing the design or tattoo on personal social media (with proper credit to the Artist)

Alterations Permitted
The Client may make any alterations to the image for personal use. Alterations do not require approval from the Artist and may be performed by:

  1. The Client

  2. The Client’s tattoo artist

  3. Another artist or designer hired by the Client

All altered versions remain derivative works of the original design, and the Artist retains full copyright of the original and any derivatives.

Credit
When sharing the artwork or tattoo publicly (online, print, or publication), the Client agrees to credit the Artist as follows:

Commercial Use Prohibited
The design (original or altered) may not be used commercially without a separate written license. This includes:

  1. Selling, distributing, or reproducing the artwork

  2. Using the image for brand logos, merchandise, or marketing

  3. Turning it into NFTs or AI products

  4. Licensing the design to third parties

Portfolio Use
The Artist retains the right to share and display the original design and creative process in their professional portfolio, social media, website, or publications. The Client may request that their identity or personal details remain confidential; this request must be made within 3 days of the completion of the experience. Requests made after this period may not be honored.

12. Governing Law

This Agreement shall be governed by, and construed in accordance with, the laws of the state/province in which Practitioner provides Services, without regard to conflict of law principles.

13. Entire Agreement

This Agreement constitutes the entire understanding between Practitioner and Client regarding the Services. No oral statements, prior agreements, or course of conduct shall have any force or effect.

By booking or participating in a session, Client confirms that they have read, understood, and voluntarily agreed to the terms of this Agreement, that they accept full responsibility for their own decisions and actions, and that they agree to the no-refund and session-forfeit policies outlined above.
